be asked to partition the
residence and, in such case,
may direct that it be sold
and the proceeds divided.
A decedent is the
person who died. Probate
is the legal process where the decedent’s assets are
distributed to the decedent’s beneficiaries. Probate may
be necessary if financial accounts do not have properly
named beneficiaries, if real property is titled solely in the
decedent’s name, or if the decedent died as a result of
medical malpractice and there is a need to commence a
wrongful death action on behalf of the decedent’s estate.
Adult guardianship is the process by which the court
finds a ward’s ability to make decisions so impaired that
the court appoints a guardian to make decisions for the
ward. Guardianship is only warranted when the court
does not find a less restrictive alternative available (such
as a durable power of attorney, health care surrogate,
trust or other form of pre-need directive).
Estate planning documents need to be reviewed
periodically. Properties might have been bought/sold,
designees are no longer the best choice or other events
have happened which made you change your mind. A
review of documents every few years helps ensure that
your documents reflect your up-to-date desires.
