        It’s The Law!

        Did You Know That, In
        Florida…

        By Adam S. Gumson,
        Esq.
          Having a trust does
        not eliminate the need for
        a will. A pour-over will
covers assets not in the trust
which may still have to go
        through probate. However,
by having a will, you are
        able to appoint a personal
        representative of your own
        choosing instead of the
court appointing one for you had you died intestate (i.e.,
        without a will).
Summary administration is a streamlined version of
probate that allows for a quicker and more efficient processing
of a deceased person’s estate. It is a “shortcut” available only
if: 1) The death occurred more than two years ago; or 2) the
total value of the estate does not exceed $75,000.
If a child support order has been violated, the nonpaying
party may be in contempt of court if the failure to pay is
deemed willful by the court. However, even if one party isn’t
paying, he/she still has a right to see his/her child so the other
party cannot deny time sharing due to nonpayment.
