It’s The Law
Did You Know That,
In Florida …
By Adam S. Gumson, Esq.
In a divorce, the process
whereby the parties engage
in the exchange of financial
information about each
party’s assets is called
discovery. In discovery, the
parties complete financial
affidavits evidencing their
income and expenses and
exchange copies of bank and
credit card statements, tax
returns and other financial information.
Probate is the court-supervised procedure for marshalling/
liquidating a deceased person’s assets, paying debts and taxes,
and distributing the assets to the person’s beneficiaries. Living
revocable trusts are popular because they help avoid probate.
A real estate contract must reflect the agreement and
understanding of both parties regarding the material terms of
the deal. Both seller and buyer must agree and understand the
deal and the concept of both parties having such a common
understanding is known as a “meeting of the minds.”
A trust describes the relationship between three separate
parties: 1) the grantor, who supplies the assets/funds; 2) a
trustee, who agrees to hold and administer the assets/funds
according to the grantor’s wishes (which are spelled out in the
trust); and 3) a beneficiary, who receives the assets/ funds.
